These Terms of Use are entered into by and between you and Care Connect Staffing. The following terms and conditions, together with any documents expressly incorporated by reference (collectively, the “Terms of Use”), govern your access to and use of all websites, portals, or pages owned or operated by Care Connect Staffing, including those accessible through careconnectstaffing.com and its subdomains, including any content, functionality, and services offered on or through such domains and subdomains (collectively, the “Care Connect Sites”), whether as a guest or registered user. Please read these Terms of Use carefully before using the Care Connect Sites. By using the Care Connect Sites, you accept and agree to be bound by these Terms of Use and our Privacy Policy, located at careconnectstaffing.com/privacy, which is incorporated herein by reference.

By using the Care Connect Sites, you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not use the Care Connect Sites.

No Guarantee of Employment

Care Connect Staffing does not guarantee you will receive any employment or job offers through the Care Connect Sites and is not your employer or agent by virtue of your usage of the Care Connect Sites.

Account Security and Confidential Information

We reserve the right to withdraw or amend the Care Connect Sites, and any service or material provided, in our sole discretion without notice. We are not liable if any part of the Care Connect Sites is unavailable at any time or for any period. We may restrict access to parts of the Care Connect Sites, including secure portals or applications (“Restricted Sites”), to users with legitimate business reasons who have registered with Care Connect Staffing or have been otherwise provided with credentials (“Registered Users”).
You agree that your use of, and access to, the Restricted Sites is limited to purposes directly related to your relationship with Care Connect Staffing. All information provided to register with the Care Connect Sites is governed by our Privacy Policy, and you consent to all actions we take consistent with that policy. You are solely responsible for all activity conducted under your credentials. Notify Care Connect Staffing immediately of any unauthorized use or security breach involving your account. Care Connect Staffing may reset, suspend, or terminate your account at any time for violation of these Terms of Use.

You agree that your use of, and access to, the Restricted Sites is limited to purposes directly related to your relationship with Care Connect Staffing. All information provided to register with the Care Connect Sites is governed by our Privacy Policy, and you consent to all actions we take consistent with that policy. Confidential Information

While using the Restricted Sites, you may access confidential information, which may include personal, professional, or business information regarding Care Connect Staffing, its affiliates, employees, customers, or contractors. You agree to use such Confidential Information only for permitted purposes and to protect it with no less than reasonable care. Confidential Information does not include information that is publicly available, lawfully obtained from a third party, or independently developed without use of confidential materials.

If legally required to disclose Confidential Information, you must notify Care Connect Staffing promptly so that appropriate protective actions can be taken.

If you discover a security breach regarding Confidential Information, you must (i) notify Care Connect Staffing immediately, (ii) investigate and share results, and (iii) assist in compliance efforts as required.

Intellectual Property Rights

All content, features, and functionality of the Care Connect Sites (including all information, software, text, graphics, images, video, audio, design, and arrangement) are owned by Care Connect Staffing, its licensors, or other providers and are protected by applicable intellectual property laws. You are permitted to use material only as expressly authorized in these Terms of Use. No right, title, or interest in or to the Care Connect Sites or any content is transferred to you.

Compliance with Applicable Laws

You agree to comply with all applicable local, state, national, and international laws and regulations regarding your use of the Care Connect Sites and any Confidential Information obtained through them.

Disclaimer and Limitation of Liability

The Care Connect Sites are provided "as is" without warranties. We are not liable for any damages resulting from your use or inability to use the Sites.

User Contributions

The Care Connect Sites may provide interactive services (“Interactive Services”) allowing users to submit content (“User Contributions”). All User Contributions must comply with the Content Standards below. By posting User Contributions, you grant Care Connect Staffing and its affiliates an irrevocable, worldwide, royalty-free license to use, reproduce, modify, and distribute such content. You represent that you own or have control over the rights to your User Contributions and have obtained all necessary permissions.

Content Standards

User Contributions must comply with all applicable laws and must not:

Be defamatory, obscene, harassing, or discriminatory
Infringe intellectual property or privacy rights
Constitute unsolicited marketing (spam)
Disrupt the operation or security of the Care Connect Sites
Mislead, impersonate, or misrepresent your identity
Violate any other provision of these Terms of Use or our Privacy Policy

Monitoring and Enforcement; Termination

We reserve the right to remove or refuse to post any User Contributions, disclose your identity to third parties claiming violation of their rights, take legal action for illegal or unauthorized use, or terminate your access for any violation of these Terms of Use. We may cooperate with law enforcement or court orders as required. We do not undertake to review all material before it is posted and are not liable for user-generated content.

Prohibited Uses

You may use the Care Connect Sites only for lawful purposes and in accordance with these Terms of Use. Prohibited uses include, but are not limited to:

Violating applicable laws or regulations
Exploiting or harming minors
Transmitting unauthorized advertising or spam
Impersonation or misrepresentation
Engaging in conduct that restricts or inhibits others’ use or that could harm Care Connect Staffing or its users

If you believe your copyright has been infringed through the Care Connect Sites, notify Care Connect Staffing in writing at the address below.

Links to Other Sites

Care Connect Staffing may provide links to third-party sites for your convenience. We have no control over and accept no responsibility for third-party content or practices.

Geographic Restrictions

The Care Connect Sites are operated from the State of Texas, USA, and are intended for users located in the United States. Access from outside the U.S. is at your own risk, and you are responsible for compliance with local laws.

Disclaimer of Warranties

Your use of the Care Connect Sites is at your own risk. The Sites are provided “as is” and “as available,” without warranties of any kind. Care Connect Staffing disclaims all warranties, express or implied, including but not limited to merchantability, non-infringement, and fitness for a particular purpose. We do not guarantee that the Sites will be error-free or uninterrupted.

Limitation of Liability

To the fullest extent permitted by law, Care Connect Staffing and its affiliates are not liable for any damages arising out of your use or inability to use the Care Connect Sites, including any direct, indirect, special, incidental, or consequential damages.

By providing your mobile number, you consent to receive SMS messages (including test messages) from Care Connect Staffing, LLC via the Vonage (formerly Nexmo) API.Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed.

Indemnification

You agree to indemnify, defend, and hold harmless Care Connect Staffing, its affiliates, officers, employees, and agents from any claims, damages, or losses arising out of your use of the Care Connect Sites, violation of these Terms of Use, violation of any third-party rights, or violation of applicable law.

Changes to the Care Connect Sites

We may update or modify the content of the Care Connect Sites at any time without notice. Content may be out of date and we have no obligation to update it.

Information About You and Your Visits

All information collected is subject to our Privacy Policy. By using the Care Connect Sites, you consent to our use of your information in accordance with the Privacy Policy.

Term and Termination

These Terms of Use are effective upon your access or use of the Care Connect Sites and remain in effect until terminated by either party. You may terminate your obligations by ceasing use of the Sites and notifying Care Connect Staffing if you wish to terminate your account. Upon termination, you must destroy all Confidential Information in your possession, unless otherwise permitted or required by law.

Governing Law and Jurisdiction

All matters relating to the Care Connect Sites and these Terms of Use are governed by the laws of the State of Texas, without regard to any choice or conflict of law provision. Any legal suit or proceeding must be brought exclusively in the federal or state courts located in McLennan County, Waco, Texas, and you consent to jurisdiction and venue in such courts.

Limitation on Time to File Claims

Any claim or cause of action arising out of or relating to these Terms of Use or the Care Connect Sites must be commenced within one (1) year after the claim accrues, or it is permanently barred.

Waiver and Severability

No waiver by Care Connect Staffing of any provision of these Terms of Use is a continuing waiver of such provision or any other provision. If any provision is held invalid, the remaining provisions remain in effect.

Entire Agreement

These Terms of Use and the Privacy Policy constitute the entire agreement between you and Care Connect Staffing regarding the Care Connect Sites.

Miscellaneous

You acknowledge that any breach of these Terms of Use may cause irreparable harm to Care Connect Staffing, entitling it to injunctive or other equitable relief. You may not assign your rights or obligations under these Terms without our prior written consent. No joint venture, partnership, employment, or agency relationship exists between you and Care Connect Staffing as a result of these Terms of Use or your use of the Sites.
